State Street Summer 2010 Rental Agreement
General
This lease agreement is jointly entered into
between ___________________________ (hereafter known as Ôthe ProprietorÕ) and
____________________________ (in combination with any/all named overnight guests
below, hereafter known as Ôthe TenantÕ) for the upper/lower/both rental unit(s)
located at 1217 State Street Saint Joseph, MI (hereafter known as Ôthe
PremisesÕ).
The term of the lease is from
_______________________ 3PM through _______________________ 11AM. The rental
fee for this term is $________ and is due in full before any occupancy will be
granted. (Checks are acceptable if issued far enough in advance of the term
such that they clear processing. Checks are not acceptable on the date of
checkin.)
Your tenancy includes the following inclusions,
not typically provided:
Pet Fee
There is a $35 fee (total for 1-2 pets) for pet
tenants. See the Pets section for guidelines governing pets.
Reservations
A complete reservation includes: payment of 50% of rental fees + the Proprietor
possessing a copy of this agreement with the TenantÕs signature.
Payment
schedule
50% of the total rental fees is due at the time
of reservation.
Any remaining rental fees are due no less than
30 days in advance of the rental term.
Any additional nights agreed to outside the
rental term as defined above are to be paid for immediately upon the agreement
to such by both the tenant and the Proprietor.
Additional nights may be available surrounding
the term. If they are available and the Tenant wishes to extend the term and
the Proprietor concurs, additional nights will be billed at the rate of $_______
, which
payment is due prior to the term to which it applies.
This lease allows for the temporary residence of
the Tenant and up to ___ additional overnight guests of the Tenants as named
below.
Additional General Inclusions
Additionally included for use by the Tenant are:
- washer/dryer
in basement
- WIFI
access
- onsite
appliances including: refrigerator/freezer, dish-washer, stove/oven, microwave,
coffee pot, iron & board, window A/C unit(s)
- TV, DVD
player, stereo system
- linens for all
beds, pillows, furniture, eating & cooking utensils for 8
- small propane
grill
Pets
A total of up to 2 dogs/cats/combo of both are
allowed on the Premises as guests as described below.
Peaceful Coexistence
Under City ordinance, it is unlawful to play or
operate any musical instrument, phonograph, or radio in such a manner as to
cause loud or unusual sound or noise between the hours of 10 PM and 7 AM; it is
also unlawful at all times to make any unnecessary loud or unusual noise which
annoys the comfort, repose, health or safety of the public.
Guidelines for peaceful coexistence with
neighbors and guests of the other rental unit at 1217 State St. which will be
the basis of the ProprietorÕs management thereof include:
- no
disruptive indoor/outdoor activity after 11PM
- parties/gatherings
on Premises should be of a size manageable by the Tenant
- no
gatherings in the front yard (facing State St.) beyond the porch
- 2
reasonable complaints in any 12hr period (as deemed so by the Proprietor) re.
noise, disturbance, or generally non-peaceful coexistent behavior will result
in the immediate dismissal of all but the Tenant from the Premises
- 3 or more
reasonable complaints during the course of the rental term (as deemed so by the
Proprietor) re. noise, disturbance, or generally non-peaceful coexistent
behavior will result in the immediate dismissal of the Tenant from the Premises
and/or up to 100% of the deposit being retained
- trash/debris
should be cleaned up the morning after any gathering on the Premises
Parking
Two (2) offstreet parking spaces are
allocated for use by the Tenant. Please park in a fashion that allows for the use of
all other spaces by other guests. Any oversized vehicles may require different
provisions as determined by the Proprietor.
Storage
Additional storage space outside of the Premises
is available and should be utilized for large/potentially dirtier items (bikes,
strollers, beach gear). The floor area inside the back entrance to the Premises
is NOT to be used for such items. The shelving unit in this area is for use by
the Tenant.
Security Deposit
A traditional security deposit is not collected.
A major valid credit card belonging to the Tenant must be provided to the
Proprietor prior to occupancy by the Tenant. The Tenant with his/her signature
hereon authorize charge(s) by the Proprietor against the credit card provided
for expenses incurred by the Proprietor during the TenantÕs stay for such
things as:
á
Excessive
cleanup (wall marring, floor scuffing/damage, spills on upholstery, stains,
etc)
á
Damage
to the rented space
á
Lost
or damaged contents
á
Unpaid
rent (additional days)
á
Lost/unreturned
key sets
An itemized receipt for charges will be
provided. Charges will be for fair market value of items or services.
Cancellation
If the Tenant chooses to cancel a reservation
for whatever reason, and the Tenant notifies the Proprietor via PHONE CONVERSATION
(no emails, no phone messages, no other) the following rental fee refund
schedule will be adhered to:
- greater than 30
complete days notification in advance of beginning of the rental term = 80% of
collected money
-
30
days or less in advance of the beginning of the rental term = NO REFUND (excepion:
the tenant will be issued a refund of 80% of the day rate if the proprietor secures another renter
for the day at the same or better day rate. This applies to all days which the
tenant has cancelled a reservation.)
Date changes may be allowed based on availability. ALL
date changes will incur a $25 fee. Date changes that reduce the number of days the
tenant will be staying will incur a $25 fee + 20% of the difference between the
initial total fees and the new total fees. Date changes within 30 days of the
tenants arrival will be handled per occurrence but are generally not allowed.
Changes to numbers of guests: a reduction
in the number of tenants will
incur neither an additional charge nor a refund. Rates are generally extended
based on 4 tenants/unit. All additions to the overnight guest list are to be
divulged to the Proprietor as additional charges may apply. The proprietor
attempts to charge fairly for the services/ lodging that is provided Ð it is
expected that an honest, accurate list of tenants will be provided and adhered
to.
Proprietor Imposed Vacating
If the Tenant is justifiably required by the
Proprietor to vacate the premises or the Proprietor cannot allow the Tenant to
take occupancy of the Premises though a reservation has been accepted, the
following refund/compensation guidelines will be applied:
- if the
Tenant has taken occupancy:
o the
Proprietor will make reasonable efforts to move the Tenant to other lodging
acceptable to the Tenant for the remainder of the term
o the
Proprietor will compensate the Tenant for 100% of the rental fee not used at
the Premises plus the difference between the rate of the Premises and the rate
at the other acceptable lodging
o the
deposit will be refunded in accordance with the section ÔSecurity DepositÕ
above
- if the
Tenant has not taken occupancy:
o 100% of
any money collected from the Tenant will be refunded to the Tenant
o if the
Tenant desires, efforts will be made by the Proprietor to secure lodging for
the Tenant for the term that was originally agreed to
o no
additional compensation will be extended the Tenant by the Proprietor
The only scenario that is suspected to lead to
the execution of this section is if the Premises become unsafe for occupancy.
In the case of a double booking (two or more Tenants errantly granted a lease
for the same or overlapping term), the Proprietor will decide to whom occupancy
will be granted and the other TenantÕs will be compensated/refunded in
accordance with the section above as begins with the phrase Ôif the Tenant has
not taken occupancyÕ.
General Safety
The Premises will have been inspected by a local
authority and deemed fit for occupancy prior to any lease granting. The
Premises has inherent dangers as does any structure (stairs, low basement
ceilings, electric & gas appliances, garbage disposal, etc..) Any
unsafe/unlawful behavior by the Tenant as determined by the Proprietor will
result in the IMMEDIATE NULLIFICATION of this lease to be followed by the
IMMEDIATE VACATING of the premises by the Tenant.
You have the right to receive a copy of the
rental unit permit, from the Proprietor, at your request. Smoke detectors
are provided in each rental unit as provided by law; no person shall tamper or
interfere with the effectiveness of a smoke detector. Violators may be punished
as provided under City ordinance.
The Proprietor and Tenant with there
signatures hereon do agree to comply with all of the terms herein:
